Can I return my rose if I'm not happy with it

"Yes, it looks alive but like I said it's been 2 months no growth. It's really frustrating. Can I return it and get a new one?

Response: Below are the photos provided. Many would agree with Amy that perhaps we should accept the return of this plant based on the unconditional guarantees offered by other businesses?... Why don't we do that? Can anyone see this is nothing but an advertising ploy to make customers think they are being looked after and hence they buy more product. We don't play the game that way. We'd rather have our customers happy with the plants in the long term. The majority of our customers love their roses and take the advice given and produce amazing results that astound me. Occasionally a rose may not be everything it could be because it's a finicky breed or it just came from not such great bud stock or it might have had anything happen to it along the way. That's plants. The legal standpoint though is who is responsible for the plant once it leaves these premises. Do I have the responisbility to ensure it is positioned to the sun, that it is watered, that it is protected, that it is not subjected to harmful substances. No; I don't. Therefore once it leaves these premises or loads into a vehicle to leave these premises, the plant is no longer my responsibility and therefore there is no legal obligation to replace the plant. If I wish to hand over my hard earned income then that's my choosing. Why should I? Did I make the plant not thrive? No; I didn't. Did the customer accept the terms and pay for the plant. Yes they did. If I bought a car and there was nothing really wrong with it. It just disappointed me. Could I take it back 2 months later and swap it for a new one? Hardly think so... They might buy it back 2nd hand for not much at all and sell you a new one if they want the old one. Same here. I think my refusal is fair in this instance. Any business who wants to offer unconditional guarantees is fine and please do take your plants back there, but take notice of how many other things you buy at the same time. I'd be interested to see if the strategy works.  :)
